Terms of Service

Last updated: September 2026

Welcome to Fact Checker ("Fact Checker," "we," "us," or "our"), a misinformation and AI-generated content detection service available via our mobile applications (iOS and Android) and our website at factcheckerapp.info (collectively, the "Service"). These Terms of Service ("Terms") govern your access to and use of the Service.

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

Fact Checker allows users to submit content — including text, links/URLs, images, and (in future releases) video — for analysis. The Service evaluates submitted content using a signals-based credibility scoring system, drawing on source-reputation checks, cross-referencing with third-party fact-checking databases, AI-generation detection signals, and reverse image/media search. Results are presented as a credibility score accompanied by supporting evidence ("exhibits"), rather than a binary "true/false" or "real/fake" verdict.

2. Not a Determination of Truth

Fact Checker provides informational signals, not definitive conclusions. Automated misinformation and AI-content detection technology is inherently imperfect and can produce false positives, false negatives, or inconclusive results. Credibility scores and exhibits are intended to help you make your own informed judgment about content — they are not a certification that content is true, false, human-made, or AI-generated. You should not rely solely on the Service to make significant decisions (including, without limitation, legal, medical, financial, journalistic, or reputational decisions) without independent verification.

3. Eligibility and Accounts

  • You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, if higher) to use the Service.
  • If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
  • You agree to provide accurate information and to promptly update it if it changes.

4. User Submissions and Content

  • Your content. You retain ownership of any text, links, images, or video you submit for analysis ("Submitted Content"). By submitting content, you grant Fact Checker a limited, non-exclusive, worldwide, royalty-free license to process, analyze, store, and transmit that content (including to third-party detection providers described in our Privacy Policy) solely to provide and improve the Service.
  • Your responsibility. You represent that you have the necessary rights to submit the content you upload, and that your use of the Service does not violate any third party's rights or any applicable law.
  • Prohibited submissions. You agree not to submit content that is unlawful, that you do not have the right to share, or that is submitted for the purpose of harassment, targeting private individuals without consent, or generating a false or misleading "credibility" result to deceive others.

5. Acceptable Use

You agree not to:

  • Use the Service to build a competing product or to scrape, reverse-engineer, or systematically extract data from the Service;
  • Interfere with or disrupt the integrity or performance of the Service (including its APIs or infrastructure);
  • Use the Service to generate or launder disinformation, or to give a false impression of authoritative "verification";
  • Attempt to bypass usage limits, subscription paywalls, or security features;
  • Use automated means (bots, scrapers) to access the Service except as expressly permitted (e.g., a published API with valid credentials).

6. Third-Party Detection Services

The Service relies on third-party providers to help generate credibility signals, which may include fact-checking databases, AI-content detection APIs, and image/media analysis services. These providers process Submitted Content on our behalf as described in our Privacy Policy. We are not responsible for the accuracy, availability, or outputs of third-party services, though we take reasonable steps to select and monitor reputable providers.

7. Subscriptions and Payments

  • Certain features of the Service may be offered on a free tier, with additional features available through a paid subscription ("Premium").
  • Payments are processed through Stripe. By subscribing, you agree to Stripe's applicable terms and authorize us (via Stripe) to charge your chosen payment method on a recurring basis until you cancel.
  • Subscription fees are described at the time of purchase. Unless stated otherwise, subscriptions renew automatically at the end of each billing period.
  • You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable.
  • We may change subscription pricing with advance notice; continued use after a price change takes effect constitutes acceptance of the new price.

8. Intellectual Property

The Service, including its design, scoring methodology, software, and branding, is owned by Fact Checker or its licensors and is protected by intellectual property laws. Except for the limited license to use the Service as intended, no rights are granted to you in our intellectual property.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT CREDIBILITY SCORES OR OTHER OUTPUTS WILL BE ACCURATE, COMPLETE, OR ERROR-FREE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACT CHECKER AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR YOUR RELIANCE ON ANY OUTPUT OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

11. Indemnification

You agree to indemnify and hold harmless Fact Checker and its owners, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms, your Submitted Content, or your misuse of the Service.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties. You may stop using the Service and delete your account at any time.

13. Changes to the Service and Terms

We may modify or discontinue the Service, in whole or in part, at any time. We may update these Terms from time to time; material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of [Insert Governing Jurisdiction], without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of [Insert Venue], unless otherwise required by applicable consumer-protection law in your jurisdiction.
